These Terms and Conditions ("Terms") govern your use of services provided by Lot Rally Pty Ltd ("Lot Rally", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Services
Lot Rally provides fleet management software, GPS tracking, route optimization, and related logistics technology services to businesses in Australia. Services are provided on a subscription basis with terms specified in your service agreement.
2. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, ensuring accurate information is provided, complying with applicable laws and regulations, and proper use of our services in accordance with these Terms.
3. Fees and Payment
Fees are charged according to your chosen subscription plan. Payment is due monthly in advance unless otherwise agreed. We reserve the right to modify fees with 30 days' notice. Failure to pay may result in service suspension.
4. Intellectual Property
All software, content, and materials provided through our services remain the property of Lot Rally or our licensors. You are granted a limited, non-exclusive license to use our services for your internal business purposes only.
5. Limitation of Liability
To the maximum extent permitted by Australian law, Lot Rally shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
6. Termination
Either party may terminate the agreement with 30 days' written notice. We may suspend or terminate your access immediately for breach of these Terms or non-payment. Upon termination, you will be provided with your data in a standard format.
7. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
